<P>PROBLEM TO BE SOLVED: To provide a radio communication device and a radio communication method, wherein a data amount to be retransmitted is reduced, even when transmission errors occur. <P>SOLUTION: A mobile phone 1 for performing communication, using a plurality of modulation systems in which a data size which can be stored in one frame is different, respectively and error resistance is low as the data size is larger, includes: a control part 30 for determining the minimum number of required frames and the modulation system of the minimum data size usable for the respective frames, on the basis of the total amount of transmission data, and dividing the transmission data into the determined number of frames; and a communication part 31 for transmitting data by using the modulation system determined by the control part 30.
