PURPOSE: A method for managing a CPU load of a contents transmitting device and a contents transmitting device thereof are provided to control a process by determining influences of a rate of using a CPU to transmission speed of a client, thereby efficiently processing contents in the CPU of the contents transmitting device. CONSTITUTION: A contents transmitting device calculates a rate of using a CPU(Central Processing Unit)(S200). The rate of using a CPU is calculated by a data input bandwidth, a data output bandwidth, a size of received data, a size of output data, and disc I/O(Input/Output) information. The contents transmitting device determines influences to a contents transmission rate of a client(S202). When the contents transmission rate does not decrease, the contents transmitting device controls present processes(S204).
