<P>PROBLEM TO BE SOLVED: To provide an ultrasonic treatment instrument having an overload prevention mechanism structured so as to permit a treatment section to grasp tissue by fixed grasping force. Ž<P>SOLUTION: When a variable handle 82 is closed, a support member 113 causes reaction force F0 of fixed strength in an elastic portion 112 in the direction opposite to the movement direction of the variable handle 82 at the time of closing. Consequently, when the strength of external force F applied to the elastic portion 112 is equal to or weaker than the reaction force F0, the shape of the elastic portion 112 is maintained in the shape as regulated by the support member 113. When the external force F stronger than the reaction force F0 is applied to the elastic portion 112, the elastic portion 112 deforms from a first elastic deformation condition, preventing the operating force of the closing operation of the variable handle from being transmitted to a driving pipe 53. Consequently, a jaw 51 does not move to the tip 32 of a probe from the position where the strength of the external force F applied to the elastic portion 112 becomes stronger than the reaction force F0 and in that condition the tissue is grasped by the treatment portion 4.
