PROBLEM TO BE SOLVED: To provide an apparatus for producing persulfuric acid, which can produce a solution containing persulfuric acid, in which sulfuric acid and persulfuric acid of high concentration coexist, and to provide a method for producing persulfuric acid. SOLUTION: The apparatus 1 for producing persulfuric acid is provided with an anode 30 and a cathode 32 and is directed for producing the solution containing persulfuric acid by passing an electric current between the anode 30 and the cathode 32 and electrolyzing a sulfuric acid solution. The apparatus further has a control means 38 for stopping the electric current that passes between the anode 30 and the cathode 32 at predetermined intervals or passing a reverse current, when electrolyzing the sulfuric acid solution.
