PURPOSE: A washing machine and a control method thereof are provided to prevent the malfunction of a drain motor by preventing overcurrent which is generated due to water between a spinning basket and a tub. CONSTITUTION: A control method of a washing machine comprises the following steps. Whether an overload of a motor occurs or not is checked with comparing a command value of the motor with a limit value which is preset during dehydrating(204). The drive of the motor is controlled according to the result(205). That the command value of the motor is greater than the limit value results the overload of the motor. If the overload of the motor is confirmed, the driving of the motor is stopped. According to the exhaust state of the water of the spinning basket in stopping of the driving of the motor, a drainage error is confirmed(207). The exhaust state of the water is decided with the comparison the water level of the spinning basket with a preset water level.
