PURPOSE: A device for processing excessive transport streams by a set top box and a method thereof are provided to process excessive transport streams stored in a point possible to process. CONSTITUTION: A controller(110) checks whether a reception transport stream number exceeds a previously defined maximum transport stream number. When the reception transport stream number exceeds the previously defined maximum transport stream number, a memory(112) stores excessive transport streams. A cable card(150) descrambles and processes the stored excessive transport streams at the point of reserve capacity. The controller reads the stored excessive transport streams from the memory.
