<P>PROBLEM TO BE SOLVED: To provide a fixing device which performs heat fixation after short warm-up time and provides a fixed image which is high in quality and has no unevenness in gloss, and to provide an image forming apparatus thereof. Ž<P>SOLUTION: In the fixing device 109, a fixing member 30 abuts on a heating member 15 via an endless film 16 to form a first fixation nip part N1, and abuts on a pressing member 20 to form a second fixation nip part N2, and then introduces a recording material P, which carries an unfixed toner image on it, into the first or second fixation nip part N1 or N2 to conduct heat fixation while clipping and conveying the recording material P. In the first fixation mode, the recording material P carrying the unfixed toner image on it is introduced into the first fixation nip part N1 and is then heated in the first fixation nip part N1 while it is being clipped and conveyed. In the second fixation mode, the recording material P carrying the unfixed toner image on it is introduced into the second fixation nip part N2 and is then heated in the second fixation nip part N2 while it is being clipped and conveyed.
