<P>PROBLEM TO BE SOLVED: To reliably actuate a safety device when temperature of a fixing belt rises excessively. Ž<P>SOLUTION: In the fixing device 1, a thermostat 9 is provided on an outer peripheral surface of the fixing belt 2 while forming a gap between the fixing belt 2 and the thermostat 9 outward in a radial direction of the fixing belt 2. The fixing belt 2 is formed by stacking three layers such as base material 2a, an elastic layer 2b, and a releasing layer 2c in order from an inner periphery side. When the fixing belt 2 is heated to exceed fixing temperature, the elastic layer 2b and the base material 2a are peeled from each other. Thus, the elastic layer 2b and the releasing layer 2c are swollen outward in the radial direction, thereby the gap between the outer peripheral surface of the fixing belt 2 and the thermostat 9 is narrowed.
