PROBLEM TO BE SOLVED: To provide a switching element in which a signal line and drive line are electrically separated, and which is suitable for prolonging a contact opening/closing life, and to provide a communication device structured by including such the switching element. SOLUTION: The switching element X1 includes a fixed part 11, a movable part 12 having a movable land part 12a, and beam parts 12b, 12c, the signal line 13 arranged over the movable land part 12a, the beam part 12b, and the fixed part 11, and having a contact part 13c on the movable land part 12a, the signal line 14 having a contact part 14a opposite to the contact part 13a, the drive line 15 arranged over the movable land part 12a, the beam part 12c, and the fixed part 11, and having a drive electrode part 15a on the movable land part 12a, and the drive line 16 having a drive electrode part 16a opposite to the drive electrode part 15a.
