PURPOSE: A mobile communication apparatus for preventing illegal use of an additional service and a method thereof are provided to disconnect a call path among an originating terminal, a receiving terminal and the third terminal if an illegal additional service is used, thereby preventing the additional service from being abused. CONSTITUTION: An application server(101) forms a call path among a plurality of receiving terminals(30,50) and an originating terminal(10). The application server watches the call path. If the call path is formed for more than a predetermined critical time, the application server transmits connection information of the originating terminal, the receiving terminal and the third terminal to an operation and management server(103).
