PROBLEM TO BE SOLVED: To provide a battery state detection device capable of detecting a micro-short circuit of a secondary battery regardless of the circumstance surrounding the secondary battery, a battery pack incorporated therewith and a battery state detection method.

SOLUTION: The battery state detection device includes: a calculation processing unit 50 for calculating the residual capacity and the full charging capacity of the secondary battery 200 and determining the micro-short circuit of the secondary battery 200 by detecting the secondary battery 200 being overcharged based on the charged capacity being charged during the charging of the secondary battery 200, the residual capacity calculated at the calculation timing immediately before the start of the charging and the full charging capacity calculated before the start of the charging; and a communication processing unit 70 for outputting the signal in accordance with the determination result by the calculation processing unit 50.
