<P>PROBLEM TO BE SOLVED: To provide a fall prevention device for an industrial vehicle in which a vehicle speed and a rear wheel load are detected and an outrigger is instantaneously overhung and a risk of falling is reduced, and to provide an industrial vehicle having the same. Ž<P>SOLUTION: The fall prevention device for an industrial vehicle includes: a vehicle body 2 of the industrial vehicle performing a loading work; a mast 7 erected in front of the vehicle body and by which a fork 13 is supported to be capable of elevating; front wheels 5 and rear wheels 4 rotatably attached to the front and rear portions of the vehicle body; a vehicle speed sensor 9 disposed to the vehicle body to detect the vehicle speed; and a rear wheel load sensor 10 detecting loads of the rear wheels. The fall prevention device further includes: the outrigger 14 disposed to a front part of the vehicle body 2 to ground the vehicle body on a road surface; and a hydraulic cylinder 8 interposed between the vehicle body 2 and the outrigger 14 to overhang the outrigger 14 into the front of the vehicle body. When the vehicle speed detected by the vehicle speed sensor 9 is zero and the rear wheel load detected by the rear wheel load sensor 10 is zero, the hydraulic cylinder 8 is extended to ground the outrigger.
