A fuel cell stack is provided with a membrane electrode assembly formed by stacking an anode electrode, a cathode electrode, and an electrolyte membrane interposed between the anode electrode and the cathode electrode, and a sealing structure for preventing fuel to be supplied to the anode electrode and gas containing an oxidizing agent to be supplied to the cathode electrode from leaking in a direction different from the stacking direction of the membrane electrode assembly, and the fuel cell stack has a configuration in which the pressing force on the anode electrode side of the sealing structure is set larger than the pressing force on the cathode electrode side.  The fuel cell stack comprising the sealing structure having excellent assembly property and replacement property, and a fuel cell using the same are provided.
