PURPOSE: An illegal communications terminal identifying method, a communications terminal, a smart card, and a recording medium recording a program implementing the method are provided to perform an identification process even in a general state as the idle state of the communications terminal. CONSTITUTION: A USIM(Universal Subscriber Identity Module) is installed in a communications terminal(110). The communications terminal reads out the IMSI(International Mobile Subscriber Identity) of the USIM. The communications terminal performs communication with a network(130). The terminal ID number of a smart card(120) and the terminal ID number of the communications terminal are compared. In case the communications terminal has illegal usage possibility, an identifier is inserted into a special message. And the message is transmitted to the network. The network performs the identification process for only a communications terminal having loss possibility by the reception of the identifier.
