PURPOSE: An apparatus and method for using guard band as data subchannel in communication system based frequency overlay are provided to increase the frequency efficiency by using the guard band locating between two FA as 'the data subcarrier for data transmission. CONSTITUTION: The controller(800) establishes the intermediate frequency between FA so that the integral multiple. The secured band resource assigning unit(812-1,812-2) calculate the number of available subcarriers within 'FA liver guard band.
