PURPOSE: An apparatus and a method for transmitting/receiving multimedia with a service quality assuring function are provided to control an encoding rate and a transmission speed according to the lowest threshold value excess throughput. CONSTITUTION: An information collecting unit(110) collects multimedia processing state information from a plurality of multimedia receiving devices. A control unit(120) produces a throughput to transmission by using the multimedia processing state information of the information collecting unit. The control unit sets an encoding rate and a transmission speed corresponding to the lowest threshold value excess throughput. An encoding unit(130) encodes a multimedia stream according to an encoding rate of the control unit. A multimedia stream transmission unit(140) transmits the encoded multimedia stream with the transmission speed of the control unit.
