<P>PROBLEM TO BE SOLVED: To provide a flame retardant polyester staple fiber having superior crystallinity despite its low melting point, having high flame retardancy, and producible with good efficiency, and to provide flame retardant polyester staple fiber which can be processed at low temperature in heat bonding when it is used as a binder fiber and can give a product such as a nonwoven structure article having excellent texture, flexibility, mechanical characteristics, and flame retardancy with high dimension stability. Ž<P>SOLUTION: In the flame retardant polyester resin comprising a dicarboxylic acid component, which principally consists of terephthalic acid, and a diol component containing 50 mol% or more of 1,6-hexandiol, a phosphorus compound is copolymerized so that a content of phosphorus atoms becomes 2,000-15,000 ppm, 0.01-5.0 mass% of a crystal nucleating agent is contained, a melting point (TmA) is 100-150°C, and the DSC curve, which is found from a DSC and shows temperature-lowering crystallization, satisfies an expression (1): b/a≥0.05 (mW/mg×°C).
