<P>PROBLEM TO BE SOLVED: To provide a driving state estimating device and a driving state estimating method for estimating whether or not a driver is in a closed-eye state and whether or not the driver is in an inattention state by specifying the eye positions of the driver based on a visible outline of a mask even when the driver wears a mask while driving. Ž<P>SOLUTION: The driving state estimating device includes: a face imaging part for imaging a face of a driver; a visible outline recognizing part for recognizing a visible outline of a mask from the face image imaged by the face imaging part; a face state recognizing part for recognizing at least either of the opening degree of the eyes or the direction of the face by specifying the eye positions of the driver based on the visible outline of the mask recognized by the visible outline recognizing part; and a driving state estimating part for estimating whether or not the driver is in a closed-eye state by the recognized opening degree of the eyes when the face state recognizing part recognizes the opening degree of the eyes, and whether or not the driver is in an inattention state by the recognized direction of the face when the face state recognizing part recognizes the direction of the face.
