A method for overload controlling between the first application and the second application based on the diameter protocol is provided. The method includes that: when the first application is overload, the overload control information is set and sent to the second application; and the second application performs action according to the overload control information. The invention also provides a diameter protocol based network element including an overload control originating equipment. The overload control originating equipment is configured for: when the overload appearing, the overload control information is set and sent to the opposite network element communicating with the network element. Otherwise, the invention also provides a diameter protocol based network element including the overload control response equipment. The overload control response equipment is configured for: when the overload control information is received from the opposite side, the action is performed according to the overload control information.
