PROBLEM TO BE SOLVED: To correctly decode POC even in random access, in the case that the POC type is type 1.

SOLUTION: An RPSEI insertion portion 110 of an encoder 100 restricts the insertion position of RPSEI, a POC decode portion 210 of a decoder 200 performs the initial setting of a frame number offset appropriately. More specifically, the RPSEI insertion portion 110 inserts RPSEI only into a reference frame of which the value of a reference frame counter is an integral multiple of the number of reference frame in a POC cycle, or the integral multiple of integral multiple of the number of reference frame in the POC cycle. Moreover, the POC decode portion 210 initializes the frame number offset so that the sign of the frame is made to be minus, when the frame into which RPSEI is inserted except an IDR frame is detected first.
