<P>PROBLEM TO BE SOLVED: To provide an electrophotographic photoreceptor that suppresses irregularities in image density due to interference and intensity changes of reflected light of the light irradiating the photoreceptor, caused by uneven thickness of a surface layer, and to provide a process cartridge having the electrophotographic photoreceptor, and an image forming apparatus with the electrophotographic photoreceptor. Ž<P>SOLUTION: The electrophotographic photoreceptor includes a conductive substrate, and a photosensitive layer, an intermediate layer and a surface layer, which are disposed in this order on the conductive substrate, wherein the intermediate layer has a layer thickness of 2 nm to 70 nm, and the refractive index n1 of the photosensitive layer, the refractive index n2 of the intermediate layer and the refractive index n3 of the surface layer satisfy an inequality (1):n2>n3>n1.
