This invention relates to a device and a method for constituting a transmission packet in a mobile communication system, particularly to a method for constituting a packet that includes at least one packet data unit (PDU) in a mobile communication system. The method comprises the steps of: determining a minimum segmentation parameter which determines the minimum size of an RLC SDU segment that is received at the last RLC PDU after being segmented, wherein the RLC PDUs are received at an MAC PDU sequentially according to priority; calculating the approximate value of an RLC PDU size that is acceptable to a remaining MAC payload of the MAC PDU; determining the size of the RLC PDU by comparing the size of the remaining MAC payload with the sum of the approximates values related to both the minimum segmentation parameter size and the RLC PDU size; creating and outputting the RLC PDU, which selectively includes the RLC SDU segment, according to the determined size.
