PROBLEM TO BE SOLVED: To provide a rubber composition which can improve dry grip performance compared with conventional tires by using the composition for tread rubber of a tire, and to provide a tire using the rubber composition. SOLUTION: Provided is the rubber composition comprising a rubber component composed of 100 pts.mass made of at least a diene polymer and 1-100 pts.mass of a copolymer resin obtained by copolymerizing a compound represented by general formula (I) in a ratio (a mass%) with indene in b ratio (b mass%), wherein the ratio (a mass%) and the ratio (b mass%) satisfy following formulas (II)-(IV). 5≤a<95...(II), 1<b≤95...(III), 90<a+b≤100...(IV).
