PROBLEM TO BE SOLVED: To provide an electronic watermark embedding device and an electronic watermark detecting device, and an electronic watermark embedding method and an electronic watermark detection method, capable of attaining excellent non-perceptibility, secrecy and robustness. SOLUTION: The electronic watermark embedding device 1 includes: a phase modulation means for performing phase modulation on a sound signal which is a digital data, by using cochlear filters 102a and 102b which simulate a cochlear characteristic; and a water mark embedding means 103 for embedding watermark data into a sound signal on which phase modulation is performed. A water mark detecting means 2 includes a phase difference detecting means 202 for detecting a phase difference of a phase spectrum between the sound signal which is an original signal, and a sound signal with a watermark, and detects watermark data which are embedded in the sound signal on the basis of the phase difference.
