PROBLEM TO BE SOLVED: To provide an optical disk recording apparatus and an optical disk recording method for properly using a recording area of a disk even when recording information into a DVD-R DL by an Incremental recording system. SOLUTION: The apparatus includes a recording area determining part which determines an area for recording file system information. The recording area determining part determines the area to record the information in a plurality of areas in the first layer and second layer of the optical disk, and determines the area such that the area in the first layer for recording the information may be located from a start address of the user area to an address of a position which is shifted by a predetermined amount from a position in the first layer on the same circumference as an innermost circumference address of the user area of the second layer.
