A scalable image encoding apparatus and a scalable image decoding apparatus are provided to determine an interpolation mode in consideration of at least one of a picture type of a current image corresponding to a scanning method of the current image and a picture type of a restoration image of an upper layer. The first encoding unit(110) encodes a current image of the first resolution into the second resolution. The first encoding unit produces a base layer bit stream for producing a restoration image of the second resolution. The second encoding unit(130) reconstructs the restoration image of the second resolution provided from the first encoding unit to a restoration image of the first resolution in correspondence to an interpolation mode signal. The second encoding unit encodes a current image of the first resolution by using the restoration image of the first resolution. The second encoding unit generates an upper layer bit stream.
