A data receiving apparatus and a receiving method thereof are provided to increase the accuracy of decoding without changing or depositing a hardware of a data receiving apparatus for increasing sampling frequency and to correct sampling errors. A data receiving apparatus(300) comprises a receiving unit(310), an A/D converting unit(320) and a signal processing unit(330). The receiving unit receives and demodulates a communication signal, and an A/D converter samples a signal demodulated by the receiving apparatus through a preset sampling frequency and converts the signal into a digital signal. The signal processing unit compares the digital signal inputted from the A/D converter with the preset reference value, and decodes the digital data through the comparison with an article code. According to the comparison result, the signal processing unit converts the digital signal into digital data that correspond to the digital signal and have positive value if the inputted digital signal is larger than the reference value. Otherwise, the signal processing unit converts the digital signal into digital data that correspond to the digital signal and have positive value.
