A moire-removing device of the digital imaging instrument and a method there are provided to secure clearness of an image by controlling a light path controller only when moire generation possibility is great of when the moire is generated. A moire-removing device comprises a moire sensor(102) and a light path controller(101). The moire sensor determines whether moire is generated or not by using an image frequency of a preview image and a spatial frequency of an image sensor(104). If the moire sensor determined that the moire is generated, the light path controller perform low band pass filtering by changing a path of light applied to the image sensor.
