An unsaturated polyester resin containing phosphate is provided to ensure excellent flame retardancy, storage, commercial availability and transparency, to be curable by a UV curing method, and to prevent faults which occurs after contraction or reaction after curing. A method for manufacturing an unsaturated polyester resin comprises the steps of: forming a mixture including alcohol 20-40 parts by weight, polybasic acid 12-40 parts by weight and phosphate derivative 17-37 parts by weight; and polycondensing polybasic acid, alcohol and phosphate derivative contained in the mixture to prepare an unsaturated polyester resin containing phosphorus. A UV curable flame retardant paint comprises the unsaturated polyester resin 35-70 weight%, extender 20-35 weight%, photoinitiator 2-5 weight%, additive 1-5 weight% and diluent 6-15 weight%.
