PROBLEM TO BE SOLVED: To provide a driver state estimating apparatus capable of estimating whether or not a driver is in the state of being unadapted to driving at appropriate time without depending on the change of the traveling environment state of a vehicle for which the driver needs to perform a steering operation. SOLUTION: In the straight traveling state of the vehicle, the pseudo disturbance torque addition determination part 1C of a driver state estimating ECU 1 determines pseudo disturbance torque to be added corresponding to the continuous operation time of the vehicle, and the addition signal is sent out to the pseudo disturbance torque addition reception part 2B of an EPS/ECU 2. As a result, by the operation of a steering actuator 3, the pseudo disturbance torque is added to the steering system of the vehicle. In this case, when the driver performs steering in response to the pseudo disturbance torque, a response steering condition detection analysis part 1D detects the delay time of the response steering by the driver. Then, a driver state estimation part 1E estimates whether or not the driver is in the state of being unadapted to driving on the basis of the response delay time, and an alarm device 4 is operated when it is in the state of being unadapted to the driving.
