A CQI reporting apparatus and a method thereof considering the number of mobile stations in a communications system are provided to allocate frequency allocation and report channel quality in consideration of the number of mobile stations. A mobile station number estimator(402) estimates mobile stations transmitting ranging request signal. A subband number and CQI(Channel Quality Information) reporting method determining unit(404) determines in consideration of the number of the presumed mobile station. An index determiner(406) transmits an index value indicating the number of subbands and the CQI reporting method.
