A device and a method for controlling a transmission rate in a broadband wireless communication system are provided to determine an MCS(Modulation and Coding Scheme) level by reflecting a reception situation of a terminal by using a MAC ARQ to OLRC(Outer Loop Rate Control). A pre-processor(306) determines a message at an MAC(Media Access Control) layer as ACK or NACK. An outer loop rate control unit updates the channel state information by using the determined ACK or NACK. An MCS determining unit(310) determines the MCS by using the updated channel state information. The transmitter transmits the signal to the determined MCS. The pre-processor uses the size of a PDU(Packet Data Unit) received in the MAC layer. The outer loop rate control unit uses the received channel state information.
