PROBLEM TO BE SOLVED: To provide a fixing device achieving stable fixing for a long time period by promoting separation of a transfer sheet, and reducing occurrence of image defect and jam defect, and also to provide an image forming apparatus using the fixing device. SOLUTION: The fixing device includes: a fixing member 1 heating a surface with a heating means by being rotated in a direction of belt peripheral rotation on an endless belt; and a pressure roller 4 forming a nip part N by being pressure contacted on the fixing member 1. The fixing device 100 passes the sheet P mounting non-fixed toner through a nip part N and fixes the toner on the sheet P. The fixing member 1 has a substrate and a laminated structure having a displacement layer dispersing and arranging a piezoelectric member comprising a piezoelectric material in an elastic layer and a mold release layer. The volume of the piezoelectric member is changed by applying voltage on the displacement layer of a sheet ejection side from the nip part N of the fixing member 1, the surface shape of the fixing member 1 is changed and separation of the sheet is promoted.
