A medium access method, an apparatus thereof and a system thereof in a wireless communications system using the persistent resource allocation are provided to increase the resource efficiency of the communications system by allocating the resource without generating empty space. An MS(Mobile Station) receiving a circuit mode resource is UL(Uplink) persistent allocation IE is received(911). In case the release resource move indicator which the received UL persistent allocation IE includes is an enable state, the MS inspects whether the circuit mode resources canceled from the UL persistent allocation burst IE which the UL persistent allocation IE includes exists(913). When the circuit mode resources exists, the MS changes the location of the circuit mode resources allotted to the MS oneself in consideration of the location of the circuit mode resources(915).
