An apparatus and a method for a high speed shared control channel less mode in a mobile communication system are provided to process an HS-SCCH order without delay, thereby reducing call disconnection. A mobile communication systems comprises a base station(220) and a portable terminal(200). When HSDPA(High Speed Downlink Packet Access) data is transmitted, the base station includes an HS-SCCH-order in an HS-SCCH. The HS-SCCH-order controls a DTX(Discontinuous Transmission) process or a DRX(Discontinuous reception) process. And the base station transmits the HS-SCCH to the portable terminal. When the HS-SCCH order included in the HS-SCCH is checked, the portable terminal performs an operation about the HS-SCCH order.
