A transport stream multiplexer and a method thereof using a padding cancellation method for improving the picture quality of a video even when using the same bit are provided to recognize overhead of the last packet generated an encoding process. A virtual packetizer(100) produces the packetized compressive stream based on a compressive stream information according to the encoding of video data performed through an encoding part(12). The virtual transport stream is produced based on the compressive stream which is packetized. The virtual packetizer extracts pattern information corresponding to overhead included in a virtual transmission stream. A DCT(Discrete Cosine Transform) controller(200) predicts the amount of bits with reference to the compressive stream received from the encoding unit and the compressive stream sensitization command received from the virtual packetizer.
