A cognitive radio terminal and a cognitive radio communication method are provided to perform the ad-hoc communication without largely influencing nodes which belong to the first network by using some of uplink radio resources of the first network or the whole. An availability radio resource determining unit(310) determines available radio resources among uplink radio resources allocated for uplink communication in the first network. An ad-hoc communication execution part(320) performs the ad-hoc communication in the second network by using the available radio resource. A power controller(330) controls the power of a transmission signal in consideration of the interference generated in a base station belonging to the first network.
