The system and the method for transmission and reception of the information on possibility of the buffer of hybrid self-acting inquiry of recurring transmission (HARQ) in a communication system of broadband wireless access are opened. The technical effect is reached because the portable station finds out capacity of own HARQ buffer and transmits the conferring including the information on found out possibility of HARQ buffer, in base station. The base station accepts this conferring and spots corresponding to a signal of transmission volume of the data which are subject to allocation of portable station, on the basis of HARQ buffer possibility so that it was possible to maintain HARQ scheme according to possibility of portable station HARQ buffer. ^ EFFECT: exception of excessive recurring transmission, a delay of the traffic and unnecessary allocation of resources. ^ 32 cl, 6 dwg, 1 tbl
