PROBLEM TO BE SOLVED: To provide an image discrimination device, an image discrimination method, and a program, which discriminates an image without reference to by what upconverting system the image is upconverted. SOLUTION: The image discrimination device includes a discrimination disturbance area excluding unit which detects a discrimination disturbance area as an disturbance to a discrimination on an image based upon an input image signal and outputs image signals corresponding to areas other than the discrimination disturbance area; a first frequency band signal detecting unit which detects signals of a plurality of frequency bands from the image signal output from the discrimination disturbance area excluding unit; a first average value calculating unit which calculates average values of characteristic values corresponding to amplitudes by the signals of the plurality of frequency bands detected by the first frequency band signal detecting unit; a first relative value calculating unit which calculates relative values of other average values to one average value among the average values calculated by the plurality of frequency bands; and a first image discrimination unit which discriminates the image, based upon the calculated relative values.
