An apparatus and a method for comprising a media access control packet in a mobile communication system are provided to comprise a MAC packet for reducing signaling overhead by using one bit data/control information field to indicate the existence of a control SDU(Service Data Unit) and positioning a MAC header in front of the MAC packet. A transmitter generates an RLC(Radio Link Control) PDU by inserting an RLC PDU header after dividing or connecting the data generated in an upper layer(601). The transmitter multiplexes the RLC PDU and inserts the multiplexed result into the MAC SDU inside the MAC PDU(603). The transmitter checks whether the MAC control SDU exists inside the MAC SDU(605). The transmitter sets D/C information to represent the existence of the MAC control SDU in front of the MAC PDU(607). The transmitter inserts the header for MAC SDU into the MAC PDU(609). The transmitter controls the size of the MAC PDU by inserting the padding into the MAC PDU to equalize the size of the MAC PDU with the transmission block size(611). The padding is inserted into the MAC header and the MAC SDU.
