A radio access bearer setup method and an apparatus thereof in a mobile communications system for setting up radio access bearer in consideration of a block error rate through ACK signal are provided to improve a call setting up success rate by retransmitting radio barer setting up to the terminal. A control station(740) transmits the radio bearer setup signal to a terminal(720)(701). The control station retransmits radio barer setup signal as predetermined maximum starting time(703). The control station measures block error rate according to the radio bearer setup signal transmission fail. If the measured block error rate is 100 percent, the control station sets up activation time by calculating minimum time capable of changing a base station. The control station transmits the radio link reconfiguration command signal including the set up activation time to the base station(730) and the base station channel is changed to the new channel(707).
