PROBLEM TO BE SOLVED: To provide an electrophotographic photoreceptor having high and stable wear resistance and scratch resistance into the inner part of a surface layer and good electric characteristics and achieving high picture quality for a long period of time, and to provide a method for manufacturing the electrophotographic photoreceptor. SOLUTION: The electrophotographic photoreceptor has a surface layer on a photosensitive layer, the surface layer containing a copolymer produced by copolymerizing with luminous energy a radically polymerizable monomer (α) having three or more functional groups and no charge transport structure with a radically polymerizable compound (β) having a charge transport structure, wherein the photosensitive layer contains at least a charge transport compound having no radical polymerizability and a binder resin having no radical polymerizability, and further contains a radically polymerizable monomer (α) having three or more functional groups and no charge transport structure and a radically polymerizable compound (β) having a charge transport structure.
