PROBLEM TO BE SOLVED: To provide a data recording device and a data recording method for reducing the storage capacity of a memory means used for recording data from an earlier time. SOLUTION: The recording device 101 comprises: a memory 105 storing data; and an HDD 102 recording the data using a disk-like recording medium. After the data storage in the memory 105 is enabled, the recording device records data in a non-controlled area 103 not controlled by a file system until data recording to a controlled area 104 controlled by the file system is enabled in the HDD.
