An available bandwidth apparatus and a method thereof for transmitting data by predicting available bandwidth of usable WLAN channel are provided to control transmission bit rate adaptively by a server and to reduce the deterioration of image quality. Predetermined current channel capacity(Rb) corresponding to received signal strength is checked from a server about received signal strength received from an application. The available bandwidth of the channel is predicted in a server by using the size of packets and the number of packets per second feedback from the application. The channel capacity is controlled in the server corresponding to available bandwidth(S5).
