PROBLEM TO BE SOLVED: To provide a rainwater treating structure and a rainwater treating method, capable of preventing pollution of underground water by initial waste water, and capable of preventing reduction in permeation capacity of a permeation basin, by directly making the waste water in the initial stage of a rainfall flow in a catchment basin without making the waste water flow in the permeation basin, by adjacently arranging the permeation basin and the catchment basin. SOLUTION: This rainwater treating structure is characterized in that: the permeation basin 5 for introducing and permeating rainwater under the ground, is made adjacent to the upstream side of an existing or new catchment basin 1 arranged on the road side; the permeation basin 5 is provided with an outflow port 6 for transferring water to the adjacent catchment basin 1 when there is inflow water of predetermined capacity or more; an L-shaped gutter block 9 composed of a curbstone part 7 being a vertical piece part and an apron part 8 being a horizontal piece part, is arranged as a cover material for covering its opening upper part; an upper surface of the apron part 8 is inclined downward in the curbstone part direction; the apron part 8 is provided with a water introducing part 10 for making the rainwater flow inside the permeation basin 1; and an impervious part 11 for blocking up a part of the water introducing part 10, is arranged in a corner part between the apron part 8 and the curbstone part 7.
