An apparatus for allocating resource for transmitting control information in a mobile communications system and a method thereof are provided to use resource transmitting the control information in an LTE mobile communications system and to prevent increase of PAPR in the LTE mobile communications system. A control information receiver inspects whether first control information and second control information are transmitted together in case that uplink transfer times of the second control information and the first control information are overlapped. A controller(710) controls in order to extract only the control information of which priority is high. A receiver performs demodulation of the extracted information.
