A background noise encoding apparatus (20) comprises a background noise analytic unit (22), a background noise classifying unit (23) and an encoding switching unit (24) as well as at least two discrete transmission units (21). The background noise encoding apparatus (20) encodes using different SID frames and a discrete transmission based upon different type of the background noise. In addition, the background noise decoding apparatus, the method and the communication devices corresponding to the background noise encoding apparatus are also designed.
