PROBLEM TO BE SOLVED: To precisely judge whether a sample is a controlled drug.

SOLUTION: The apparatus (1) for discriminating a controlled drug is equipped with a similarity degree calculation means (C3) for comparing the measured spectrum of an inspection target sample (T) with a known spectrum to calculate a degree (S) of similarity and a controlled drug discrimination means (C8) for judging the inspection target sample (T) as the controlled drug in the case where a known sample has the maximum degree (S1) of similarity highest in the degree (S) of similarity, while the maximum degree (S1) of similarity is the maximum discrimination degree (H1) of similarity or above and similarity degree difference (Sa) being the difference between the different kind maximum degree (S2) of similarity highest in the degree (S) of similarity in the known sample of a kind different from the maximum degree (H1) of similarity and the maximum degree (H1) of similarity is a difference discrimination value (H2) of the degree of similarity.
