A voice activity detecting device comprises a background analyzing unit which is used to analyze the characteristic of a background noise of current signal according to the input result of VAD judge and obtain the parameter relating to the wave characteristic of the background noise and then output; a threshold amending unit for the VAD judgement which is used to obtain the threshold amending value for the VAD judgement and output according to the parameter output from the background analyzing unit; a VAD judgement unit which is used to amend the going amending threshold for the VAD judgement according to the amending value output from the threshold amending unit for the VAD judgement, and judge the background noise according to the amended threshold for the VAD judgement, and output the result of the VAD judgement. A voice activity detecting method is provided according to the voice activity detecting device.
