A system for transmitting/receiving data and a method thereof are provided to transmit/receive streaming data appropriately by preventing an underflow or overflow state. A data system comprises a transmitter(110) and a receiver(120). The transmitter has a transmission buffer to transmit a plurality of encoded data packets. The level of the transmission buffer is encoded by one of the encoded data packets. The receiver has a receiving element for receiving the encoded data packets, and then generating a plurality of decoded signals.
